Abstract

This dissertation aims to investigate the social and legal dimensions of the electronic judicial process implemented in the Labor Court. On the other hand, it also evaluates the efficacy and effectiveness of government action as a public policy management instrument. The present work is justified by analyzing the impact of the implementation of the electronic judicial process, in relation to the processing time of the judicial processes, bringing a practical analysis of the different tasks created within the electronic process. Thus, considering the proposed objectives and the research question, this investigation makes use of an exploratory, descriptive and inferential approach, in the form of multi-articles, through the analysis of primary data with the objective of identifying, from the point of view of the user of the system of the PJE, the innovations and changes in the reality of the Labor Court, with the implementation of the electronic judicial process. The basis of the investigation is organized into three theoretical and empirical essays, namely: 1) “The investigation model applied to the analysis of the electronic judicial process system implemented in the Labor Court: theoretical essay”. This theoretical essay had as its guiding object the definition of a conceptual and operational model of investigation based on the epistemology of the computerization of the judicial process, public management and procedural legal governance, having as reference the construct called PJE - Electronic Judicial Process and its dimensions of analysis. Based on the construct, logical structure matrices were elaborated that describe the dimensions, indicators and scope of the investigation model applied to operators of law in the Labor Court; 2) “Statistical compliance and validation tools applied to the PJE investigation model - Electronic Judicial Process and its dimensions of analysis”. The purpose of this article is to endorse the construct called PJE - Electronic Judicial Process and its dimensions of analysis. The basis of the investigation is conceived from the explicit theoretical model, through the application of statistical conformity tools to endorse its operability from a primary database. To validate the data collection instrument, statistical tools CVP-Pearson's Coefficient of Variation and Cronbach's Alpha were used; 3) “The Electronic Judicial Process of the Labor Court: an empirical study”. The present study analyses, from the perspective of the operator of law, the social and legal dimension of the implementation of the Electronic Judicial Process - PJE as a governmental action of public policies, as well as the evidence on the innovations and changes in the Labor Court with the implementation of the said electronic process system. In this study, the F statistic was used to obtain the significance test of the hypotheses. The operationalization of the study variables, measured from the degree of association between the analysis dimensions of the explained variables and the explanatory variables, at a significance level of P≤0,05, aimed to identify evidence of association between policy management of the judiciary in the context of organizational and technological innovations. Finally, it is concluded that, based on the evidence presented by the results of the empirical data set analyzed, in the perception of the legal operator, the Electronic Judicial Process of the Labor Court brought a series of innovative transformations in the provision of judicial services, with emphasis on economy and efficiency of public management. Also noteworthy is the agility of decisions related to administrative and procedural management. In addition to the temporal reduction of the procedure between the filing of the action and the result of the sentence.
