Abstract

The dignity of the human person is a fundamental principle of Brazil's 1988 Federal Constitution, enshrined in article 1, item III. Based on this premise, this study offers a descriptive and legal analysis of the situation in the Daiana district in Silvânia, Goiás. The main objective of this research is to understand the patterns of territorial occupation in the border area between the municipalities of Anápolis and Silvânia, in the period between 1980 and 2024, and their respective consequences. This analysis considers the historical evolution of the Daiana district, examining the relationship between the municipal government and the process of occupation of the subdivision, outlining the powers and responsibilities of administrative management, identifying the legal framework applicable to the implementation of subdivisions and territorial expansion and, finally, the exposure of legislation of Brazilian positive law that have an immediate effect on the provision of basic public services. To this end, the study adopts the methodology of bibliographical research, addressing the concept of territory, the notion of a state of exception, as interpreted by Giorgio Agamben, and the classic theories of Administrative Law on public administration, public services and government responsibility. The results reveal the explicit characterization of a modern state of exception manifested in the municipality that is the subject of this study
