Legislação ambiental brasileira : um estudo de caso de concessões de licenciamentos ambientais a partir da análise de ação civil pública em tramitação na Vara da Fazenda Pública Municipal de Itumbiara-GO, 2017-2019

Abstract

The research includes the exposition on the historical process of human interference in nature, the global environmental crisis and sustainability, in which they are exposed from federal environmental legislation to municipal regulations. The general objective of the research is, from the study of public civil action in progress at the Municipal Public Treasury Court of Itumbiara-GO, to identify the consequences to the environment and public health when the licensing process is carried out in disagreement with the legislation. environment and to the detriment of the principles of Public Administration. Public action will be the source of research to obtain data on licensing procedures carried out in the city in breach of legislation, demonstrating the damage to the environment and public health. In compliance with the Data Protection Law, Law No. 13,709/2018, the nomenclature, identification or specification of the locations, developments, subdivisions, etc., which appear in the merits of the action, will not be included in the research. The data of the information contained in the judicial process were used to contemplate the objectives of the research. In the analyzed licensing processes, it was possible to identify the damages to the environment and public health, due to non-compliance with environmental legislation. It is important that the public authorities act in compliance with environmental laws, as the liabilities generated may be irreversible.
